Terms and Conditions
The owner of the online store www.lindenhill.ee (hereinafter referred to as the “Online Store”) is Lindenhill OÜ (reg. no. 16159174), located at Ööbiku 2a-13, Tallinn, 11315, Harju County, Estonia.
Validity of the Sales Agreement, Product, and Price Information
These terms and conditions apply to the purchase of goods from the Online Store.
The prices of the products sold in the Online Store are indicated next to the products. The price includes the cost of delivery.
The delivery fee depends on the buyer’s location and the delivery method. The delivery fee is displayed to the buyer during the order process.
Information about the goods is provided directly next to the goods in the Online Store.
Placing an Order
To order goods, you need to add the desired products to the shopping cart. To finalize the order, you need to fill in the required data fields and select the appropriate delivery method. The total amount payable will then be displayed, which can be paid via a bank link or other payment solutions.
The agreement enters into force from the receipt of the payment in the Online Store’s account.
If the ordered goods cannot be delivered due to the goods being out of stock or for any other reason, the buyer will be informed at the earliest opportunity, and the money paid (including delivery costs) will be refunded promptly, but no later than 14 days after the notification is sent.
Delivery
Goods are shipped to the following countries:
- Estonia: 1-5 days
- Europe: 5-10 days
- Outside Europe: 10-20 days
The shipping costs are borne by the buyer and the corresponding price information is displayed next to the delivery method.
Domestic shipments generally reach the buyer’s specified destination within 1-3 business days after the sales agreement enters into force. Delivery outside of Estonia takes place within 5-20 calendar days.
In exceptional cases, the Online Store reserves the right to deliver goods within up to 45 calendar days.
Right of Withdrawal
After receiving the order, the buyer has the right to withdraw from the sales contract concluded in the Online Store within 14 days.
[Depending on the products, the buyer may not have the right of withdrawal. In such cases, the relevant products and services must be listed and comply with the conditions stipulated in subsection 4 of § 53 of the Law of Obligations Act.]
The right of withdrawal does not apply if the buyer is a legal entity.
To use the 14-day right of return, the ordered goods may not be used in any other way than necessary to ascertain the nature, characteristics, and functioning of the goods, in the same way, the goods can be tested in a physical store.
If the goods have been used for a purpose other than necessary to ascertain the nature, characteristics, and functioning of the goods or show signs of use or wear, the Online Store has the right to reduce the refundable amount according to the decrease in the value of the goods.
To return the goods, a withdrawal statement must be submitted and sent to the email address kristjan@lindenhill.ee no later than 14 days after receiving the goods.
The costs of returning the goods are borne by the buyer, except in cases where the reason for return is that the returned item does not correspond to the order (e.g., wrong or defective item).
The buyer must return the goods within 14 days of submitting the withdrawal statement or provide proof that they have handed over the goods to the carrier within the aforementioned period.
Upon receiving the returned goods, the Online Store will refund the buyer immediately, but no later than 14 days after receiving the withdrawal statement, all payments received from the buyer under the contract.
The Online Store may withhold reimbursement until it has received the goods or until the buyer has provided proof of sending back the goods, whichever occurs first.
If the buyer has explicitly chosen a delivery method other than the least expensive standard delivery offered by the Online Store, the Online Store is not required to refund the cost that exceeds the cost of the standard delivery.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods if the price of the goods in the Online Store has been mistakenly marked significantly below the market value of the goods.
Right to File a Complaint
The Online Store is responsible for any non-conformity or defect of the goods sold to the buyer that existed at the time of delivery and that manifests within two years after the delivery of the goods to the buyer. Within the first six months after delivery to the buyer, it is presumed that the defect existed at the time of delivery. The Online Store must refute this presumption.
The buyer has the right to contact the Online Store within two months of discovering a defect by sending an email to kristjan@lindenhill.ee.
The Online Store is not liable for defects that occur after the delivery of the goods to the buyer.
If goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund the buyer all payments involved in the sales contract.
The Online Store will respond to the consumer’s complaint in writing or in a form that can be reproduced in writing within 15 days.
Direct Marketing and Processing of Personal Data
The Online Store uses the personal data entered by the buyer (including name, phone number, address, email address, payment details) only for processing the order and sending the goods to the buyer. The Online Store forwards personal data to companies providing delivery services to deliver the goods.
The Online Store sends newsletters and offers to the buyer’s email address only if the buyer has expressed a wish to receive such direct marketing messages by entering their email address on the website and indicating their desire to receive direct mail notifications.
The buyer can opt out of offers and newsletters sent to their email at any time by notifying us via email or by following the instructions provided in the email containing the offer.
Dispute Resolution
If the buyer has any complaints regarding the Online Store, they should be sent to the email address kristjan@lindenhill.ee.
If the buyer and the Online Store cannot resolve the dispute by agreement, the buyer may contact the Consumer Disputes Committee. You can review the procedural terms and submit a complaint here. The Consumer Disputes Committee has the authority to resolve disputes arising from the contract between the buyer and the Online Store. The review of the buyer’s complaint by the committee is free of charge.
The buyer may also refer the matter to the European Union’s Online Dispute Resolution platform.
